Malay Perfumery sells fragrance products through its e-commerce platform hosted on Shopify.

We reserve the right to:

  • Modify or discontinue any Product without notice

  • Refuse service to anyone for lawful reasons

  • Limit quantities per order or per customer

  • Restrict sales to certain geographic regions

We may expand to international markets in the future. Where international sales are offered, additional terms may apply.

4. Product Information & Disclaimer

We make commercially reasonable efforts to ensure product descriptions, images, and pricing are accurate. However:

  • Colours and packaging may vary due to display settings or supplier updates.

  • Fragrance performance (longevity, projection, scent perception) may vary depending on individual skin chemistry and environmental conditions.

All Products are sold “as is” and “as available,” except as required under applicable consumer protection laws.

5. Orders & Contract Formation

An order placed on the Website constitutes an offer to purchase. A binding contract is formed only when we issue an order confirmation email.

We reserve the right to cancel or refuse any order, including but not limited to:

  • Suspected fraudulent transactions

  • Pricing errors

  • Product unavailability

  • Regulatory or shipping restrictions

If payment has been processed for a cancelled order, a refund will be issued to the original payment method.

6. Pricing & Currency

  • Prices are displayed in the currency indicated on the Website.

  • For international orders (if available), currency conversion rates are determined by your payment provider.

  • Customers are responsible for any applicable taxes, duties, customs fees, or import charges imposed by their jurisdiction.

We reserve the right to correct pricing errors at any time.

7. Payment

Payments are processed securely via Shopify and its approved payment gateways.

We do not store full payment card details.

By submitting payment information, you represent that:

  • The billing information provided is accurate and complete.

8. Shipping & Risk of Loss

Current Shipping Scope

Malay Perfumery currently ships within Malaysia only. If international shipping becomes available, additional delivery terms will apply.

Risk Transfer

Risk of loss and title to Products pass to the Customer upon delivery to the carrier or delivery address, as permitted by applicable law.

We are not liable for delays caused by:

  • Courier services

  • Customs clearance

  • Force majeure events

  • Incorrect shipping information provided by the Customer

9. Returns & Refunds

Due to the hygienic and consumable nature of perfume products:

  • Opened or used Products are generally non-refundable unless defective.

  • Claims for damaged or incorrect items must be made within [X] days of delivery.

All returns must comply with our Refund Policy.

Nothing in these Terms excludes or limits statutory consumer rights that cannot be lawfully excluded.

10. International Compliance (Future Expansion)

If we offer international sales:

  • Customers are responsible for ensuring Products comply with local laws in their jurisdiction.

  • We are not liable for Products confiscated, restricted, or delayed by customs authorities.

  • Any import restrictions applicable to alcohol-based fragrances are the Customer’s responsibility.

11. Intellectual Property

All Website content, including but not limited to text, product descriptions, branding, logos, images, graphics, and design elements, is the exclusive property of Malay Perfumery.

Unauthorized reproduction, distribution, modification, or exploitation is strictly prohibited.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Malay Perfumery shall not be liable for indirect, incidental, special, or consequential damages.

  • Our total aggregate liability arising out of or relating to any order shall not exceed the purchase price of the Product giving rise to the claim.

Nothing in these Terms limits liability for fraud, willful misconduct, or liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Malay Perfumery from any claims, damages, losses, liabilities, costs, or expenses arising from:

Unless otherwise required by mandatory consumer protection laws in your country of residence:

These Terms shall be governed by and construed in accordance with the laws of Malaysia.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
